Guidelines for NCS Foods

REQUIREMENTS FOR PROCESSING APPLICATIONS FOR PERMIT TO IMPORT CONTROLLED SUBSTANCES LISTED IN SCHEDULE II OF THE FOOD AND DRUGS DECREE OF 1974 AND THE 1971 UN CONVENTION ON PSYCHOTROPIC SUBSTANCES.

 

  1. An application in duplicate addressed to the Director–General NAFDAC, Oshodi, Lagos. Attention Director Narcotics and controlled substances Directorate (on the company’s official letter head) containing: -
  1. Name(s) of Product(s), Dosage form(s), Pack size, quantity, and strength per unit dose and total weight of controlled substance per consignment in kilograms (kg)
  2. Name and address of Manufacturer(s)
  3. Name and address of Exporter or Forwarding Agent.
  4. Name and Signature of Superintendent Pharmacist.

 

Please note that the address on the company’s official letterhead must be the same as the registered address on the certificate of Registration/Retention of Premises.

In case of importers of registered energy drink, registered premises and superintendent pharmacist is not required.

2. A PHOTOCOPY OF:-

  1. The current Annual License to Practice of the Superintendent Pharmacist (to be tendered once a year).
  2. The current Certificate of Registration/Retention of Premises (to be tendered once a year).
  3. Proforma Invoice.
  4. Any supporting document to justify importation of large quantity of a controlled substance e.g. Government Tender Award.
  5. Product Registration License with the Drug Registration Directorate, NAFDAC,   as any unregistered product is deemed illegal and treated as fake drug.
  6. Evidence of Current GMP (where applicable) and membership of relevant sectoral/technical group.
  7. Certificate of Incorporation from CAC, Memorandum & Article of Association, particulars of Directors(for fresh applicants)
  8. Tax clearance certificate from FIRS(for fresh applicants)
  1. Application for registration samples shall be accompanied by permit to import registration samples/letter of confirmation of commencement of registration process from R&R

 3. PLEASE NOTE

ALL ORIGINAL DOCUMENTS ACCOMPANYING THE APPLICATION MUST BE SIGHTED AT THE TIME OF SUBMISSION.   ANY COMPANY THAT FAILS TO OBTAIN PERMIT TO CLEAR WILL BE PENALIZED FOR CONTRAVENING THE FOOD AND DRUGS ACT OF 1974. AND THE NAFDAC DECREE OF 1993 AS AMENDED AND WILL BE REFERRED TO DIRECTOR OF ENFORCEMENT and /or NDLEA FOR APPROPRIATE DISCIPLINARY ACTION.

4. The Disposal Records of previous imports MUST BE SUBMITTED before a fresh application for permit to import can be received (this does not apply to first time applicants).

5. PERMIT FOR CLEARANCE OF IMPORTED CONSIGNMENTS

The following are required from every applicant:

Application letter addressed to the Director General (NAFDAC) Attn: Director, Narcotics and Controlled substances Directorate, Oshodi, Lagos, stating name and quantity of product, the port of entry and submitted with the following documents (ORIGINALS FOR SIGHTING AND PHOTOCOPIES FOR OFFICE USE)

  1. Permit to Import.
  2. Invoice (Customs)
  3. Bill of Entry (SGD form)
  4. Bill of Lading.
  5. Airway Bill (where applicable)
  6. Commercial Invoice.
  7. Form M
  8. Packing List
  9. Risk Assessment Report (RAR)
  10. Certificate of Analysis/Quality Control Certification – Name, Signature and Designation of Analyst to be clearly indicated.
  11. The original copies of all shipping documents must be presented for vetting at the Division.
  12. Clean Report of Inspection and Analysis (CRIA) from NAFDAC Quality Control Agents for Finished Controlled drugs coming from India, China and Egypt

     CHARGES

            Permit to import                                     N21, 000.00 per item

            Permit to clear per bill of entry                N10, 500.00

            Inspection (warehouse Inspection)          N10, 500.00

            Follow up Inspection                               N5, 250.00

           

  • Importation without permit               N500,000.00
  • Clearance without permit to clear     N150,000.00
  • Any repetition of this act will result in prosecution of the importer
